Contract upon the covenant against incumbrances contained in a deed from the defendants to the plaintiff dated May 24, 1866. After the former decision, reported 108 Mass. 175, the case was tried in the Superior Court, before Bacon, J., who allowed a bill of exceptions in substance as follows : The land in question is situated in New Bedford, and came to the defendants under the will of the late Timothy G.
