Noonan, J.:

The petitioner Konstanty Wroblewski is seeking to vacate -a deficiency judgment entered against him and others in the above-entitled action which was brought to foreclose a mortgage upon real property in Boston, N. Y.

The sole ground for his motion is the. fact that the notices of sale were not posted according to section 712 of the Civil Practice Act, which provides that: “ * * * 1. A written or printed notice thereof must be conspicuously fastened up at least forty-two days before the sale, in three public places in the town or city where the sale is to take place, and also in…
