Appellant was convicted of murder in the first degree, and his punishment assessed at-confinement in the penitentiary for life.
In regard to the application for continuance, it is sufficient to say that one of the witnesses appeared during the trial and appellant declined to use his testimony; and for the other two, appellant declined to have further process issued. The application further recites there was considerable excitement over the case throughout the county, and that for this reason the continuance should have been granted.
