POWERS, Justice.

In July 1985, after notice and hearing, the State Department of Health issued to E & D Waste Systems, Inc. a permit authorizing the company to construct and operate a municipal solid-waste facility in Galveston County. The company’s application for the permit was opposed in the agency proceedings by the County and numerous individuals who are appellants here. 1 Appellants sued in district court for judicial review of the agency order directing that the permit be issued.
