[¶ 1] Roger L. Habrle appeals from an order entered in the District Court (Houl-*641ton, O’Mara, J.) denying his motion to vacate a divorce judgment dissolving his marriage to Brenda R. Brown. Habrle contends that, because he was not served by the clerk of the court with notice of the filing of the referee’s report pursuant to M.R. Civ. P. 53(e)(1), the court erred in denying his motion to vacate the divorce judgment, which incorporated the terms of the report. We agree with Habrle’s contention, and vacate the judgment.1
