The case comes before the court on the defendant’s motion for review of the magistrate judge’s order of May 9, 1996, (Dk. 48), which denied the defendant’s third motion to compel. This is an action under the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621, et seq., and the Kansas Age Discrimination in Employment Act, K.S.A. 44-1111, et seq.
