I agree with paragraphs 1 and 2 of the syllabus and with those parts of the opinion prepared by Judge Morris to which those paragraphs relate; but I do not agree with the remainder of the opinion or with the concurring opinion of the Chief Justice. I am of the view that the questions of negligence, contributory negligence, and assumption of risk were for the jury, and that the verdict of the jury is supported by the evidence.
