A motion is made by the defendant, on affidavits, to set aside the verdict of the jury rendered in this case, for misconduct during their deliberation. The case was tried at this trial term of the court, occupying something' over two weeks. The case was submitted to the jury under a charge by the coilrt, and they retired, in charge of two sworn officers, at about seven o’clock in the evening, they having been instructed to seal their verdict in case they should agree before the court convened in the morning.
