The defendant, the New York Central & Hudson River Railroad Company, a domestic corporation, stands indicted with having knowingly failed to file with the Interstate Commerce Commission its tariff of rates and charges for conveying petroleum from Rochester to Norwood, in the state of New York, which it had established under a common arrangement with the Pennsylvania Railroad Company, the Central Vermont Railway Company, and the Rutland Railroad Company for a continuous carriage interstate from Olean, N. Y., to Burlington, Vt, in violation of section 1 of the Elkins Act,…
