Affirming.

On April 20, 1931, the first day of a special term of the Hardin circuit court, Walter Holmes, alias Jack Strong’, Charles Rodgers, and Walter Dewberry, all negroes, were jointly indicted for the murder of Thomas Tillery. Separate trials of the defendants at the same term resulted in judgments of conviction carrying a death penalty. They have prosecuted appeals.
