MERHIGE, District Judge.
Aubrey H. Thompson brings this action under Section 205(g) of the Social Security Act, as amended 42 U.S.C. § 405(g), to review a final decision of the Secretary in which it was held as a matter of law that the actual expenses he incurred as a city councilman could not be excluded from his gross income in determining “excess earnings” for the purpose of imposing deductions on his old-age insurance benefits under Sections 203(b) and (f) of the Act, 42 U.S.C. §§ 403(b) and (f).
