Plaintiff filed this action in the Circuit Court of the City of St. Louis seeking damages pursuant to the Federal Employers’ Liability Act, 45 U.S.C., § 51, et seq. Defendant filed a Motion to Dismiss for Improper Venue alleging by affidavits that when the suit was filed it no longer operated a railroad or maintained an office or agent in the City of St. Louis or in the State of Missouri. After a hearing, this motion was sustained and plaintiff’s action was dismissed for improper venue. Plaintiff appeals this order. Defendant has filed a motion to dismiss the appeal on…
