OPINION

SWEET, District Judge.

This motion arises out of plaintiff Med-Sales Associates (“Med-Sales”) libel suit against defendant Lebhar-Friedman (“Leb-har”). Lebhar has moved pursuant to Fed. R.Civ.P. 56 for an order dismissing the complaint. For the reasons stated below, the motion is granted and the complaint dismissed.

The U.S. House of Representatives Subcommittee on Oversight and Investigations of the Committee on Energy and Commerce (the “Subcommittee”) held a public hearing on July 10, 1985 in Washington, D.C. on the subject of “Prescription Drug Diversion and Counterfeiting.”
