State v. Knight

Supreme Court of Arkansas

Decided October 3, 1994No. CR 94-481PublishedCited by 14 opinions

1Opinion of the Court

Robert L. Brown, Justice.

This is an appeal by the State of Arkansas. The State contends that the circuit judge erred in reducing the charge against appellee Timothy D. Knight to possession of a controlled substance — methamphetamine — after Knight had pled guilty to possession of that controlled substance with intent to deliver, and in then placing Knight on supervised probation. We agree with the State that probation constituted an illegal sentence, and we reverse the order of probation and remand the case for resentencing in accordance with the plea of guilty and this opinion.
