This appeal arises out of an action for damages resulting from injuries sustained by the plaintiff when he fell into a water meter pit or manhole located in a public sidewalk of the city of Concordia, appellant herein.

On January 10, 1953, the appellee, hereafter referred to as the plaintiff, was an employee in a garage on Seventh Street in the city of Concordia. The garage faced south on Seventh Street which ran east and west. A public sidewalk occupied Seventh Street from the front of the garage to the curb of the street. Approximately…
