ORDER

CHAPMAN, District Judge.

This matter is before the Court under a Rule to Show Cause dated May 29, 1974 directing defendants to appear and show cause why they should not be temporarily and permanently enjoined from enforcing a recently enacted regulation of the Secretary of Agriculture regarding the marketing of tobacco.

The defendants have moved to dismiss the action on the ground that the Court lacks jurisdiction of the matter and the complaint fails to state a claim upon which relief can be granted; or in the alternative, for summary judgment on the ground that there is no genuine issue…
