This is an action by plaintiff PM Farms seeking review of a final determination by the National Appeals Division (“NAD”) of the United States Department of Agriculture (“USDA”) upholding a $10,000 Graduated Pay Reduction (“GPR”) penalty for 2013 crop year violations of Highly Erodible Land and Wetland Conservation (“HELC”) regulations applicable to certain fields of PM Farms’ land.
