— In this action the question of whether or not one Frank Hamarstrom was engaged in interstate commerce at the time he received injuries, on May 10, 1934, from which he died, is the vital and controlling issue.

This cause is now before us upon rehearing. In an opinion handed down by this court at the March term, 1937, this court affirmed the judgment of the circuit court in affirming the Workmen’s Compensation Commission of Missouri, awarding compensation to the respondent herein for the death of her husband, Frank L.
