This cause reached the circuit court of Greene county upon a change of Venue from the circuit court of Howell county, and the controversy is over the trial court’s action in sustaining a demurrer to the third amended petition of plaintiff; the petition, and the first And second amended petitions having been adjudged insufficient on demurrers.
