Plaintiffs appeal by leave granted the June 15, 1979, order of the circuit court affirming a November 13, 1978, order of the district court adjudging the Michigan Department of State in contempt for failure to issue defendant a restricted motor vehicle operator’s license.

On May 28, 1978, defendant was charged with the offense of driving a motor vehicle while being under the influence of intoxicating liquor (DUIL). MCL 257.625; MSA 9.2325.
