delivered the opinion of the court.

This writ of error is brought to reverse a judgment of nil capiat and for costs rendered by the Municipal Court of Chicago January 28, 1914, against Charles H. Gersch, the plaintiff below, who sued the City of Chicago in that court for $3,000, which his statement of claim alleged was due to him as “salary already accrued, accruing and due to him” as a policeman from the 2nd day of December, 1910, up to the time of beginning the suit, March 6, 1913.
