Reversing.

William Miller, at the age of 62, executed the will in controversy on September 6, 1859, and died on September 10,1862, a resident of Jefferson County and the will was there probated. When the will was executed and up to the time of his death, testator’s immediate family consisted of himself, his wife and his only child, Martha, who afterwards became Mrs. Norris. He was survived by both his wife and daughter. Testator had a brother and three sisters all of whom survived him but have since died leaving numerous descendants who are appellants herein.…
