GIVENS, Commissioner.

— Plaintiffs and appellants, Nielson and Walker, leased to Thomas E. Fitzgerald thirty-five rooms, or all of the second floor of a building in Burley, for a period of ten years, at an annual rental for the first five years of $4,200, payable $350 per month in advance, and for the last five years at an annual rental of $4,500, also payable in advance monthly payments.

Among other conditions, the lease contained the following provisions:

“And it is hereby agreed that if the rent herein provided for to be paid to the first parties, or any part thereof, shall not be paid…
