Before the Court is Defendant Laticrete International’s (Laticrete) Motion to Dismiss, filed May 20, 1996. Plaintiff EMJ Corporation (EMJ), a general contractor which was involved in a construction project at the Georgia Square Mall in Athens, Georgia, brought suit in the Superior Court of Clarke County, Georgia, against Laticrete, a Connecticut corporation in the business of producing building materials.
