This is an action of contract in which the plaintiff seeks to recover a certain sum paid by it to one Mank, an employee of the defendant, in settlement of the claim of Mank against the defendant for compensation for personal injuries which he sustained while engaged in the business of the defendant, as a result of the negligent operation of the latter’s automobile upon the ways of the Commonwealth. The defendant’s answer contains a general denial and further alleges that the terms of the policy of insurance under which the plaintiff seeks recovery are in contravention of public policy.
