—In an action to recover damages for personal injuries, etc., the defendants appeal from an order of the Supreme Court, Suffolk County (Berler, J.), dated February 4, 2002, which denied their motion for summary judgment dismissing the complaint.

Ordered that the order is modified, on the law, by deleting the provision thereof denying that branch of the motion which was for summary judgment dismissing those portions of the complaint which were based on the defendants’ alleged negligence prior to June 30, 1997, and substituting therefor a provision granting that branch of the motion; as so…
