GOODWYN, Justice.

Petition of Sam Joseph Flail, Jr., for certiorari to the Court of Appeals to review and revise the judgment and decision of that court in the case of Hall v. State, 36 Ala.App. 590, 61 So.2d 773.

The Court of Appeals reversed the judgment of conviction on the ground that “the evidence adduced fails to show that defendant was a vagrant within the meaning of any of the subdivisions of the ordinance”; and further held that “the trial court erred in denying appellant’s motion to exclude the evidence and discharge defendant”.
