Plaintiff, as payee, brought separate suits in assumpsit, one against Drexel National Bank upon a check drawn by Harry S. Feldman in the sum of $5,000, and the other against the National Bank of Hyde Park upon a check drawn by Morris Kaplan in the sum of $3,200. He alleged that his indorsement as payee on these checks was forged and that he did not receive any money from the proceeds thereof. The checks were presented for payment to the defendant banks by the First National Bank of Chicago, which indorsed them and guaranteed prior indorsements.
