DONOVAN, District Judge.

This case is before the court on petitioner’s motion for summary judgment. 1 The motion is based upon the pleadings, exhibits and affidavits filed with the court. The parties will be referred to as petitioner and respondent.

The file reveals that respondent is a common carrier by air in interstate and foreign commerce, operating domestic and foreign routes under certificates of public convenience and necessity issued by the Civil Aeronautics Board.
