Plaintiff Delaware County Fraternal Order of Police filed a complaint in mandamus against defendant borough, its councilmen and their appointed arbitrator to compel them to proceed to arbitration to settle the contract dispute between the Norwood Borough Police and the borough. Plaintiff also moved for peremptory judgment on the pleadings.

Defendants have filed preliminary objections to both plaintiff’s complaint and amended complaint. Resolution of the issues raised by the preliminary objections and plaintiff’s motion for peremptory judgment is now before us.
