This is an action for money had and received. To have reviewed a judgment for defendant, plaintiff has sued out a writ of error. The parties are herein designated as they appeared in the court below.

On September 13, 1941, plaintiff brought this action against defendant to recover 3.1 per cent of one hundred thousand dollars, or three thousand one hundred dollars, plus interest, which he alleged was due him under the terms of an oil leasing contract, of date October 26, 1921.
