Familiarity with the Court’s factual findings in this case, as set forth in the Court’s prior reported decision, Motorola Credit Corp. v. Uzan, 274 F.Supp.2d 481 (S.D.N.Y.2003) (“Uzan I”), and affirmed by the Court of Appeals, Motorola Credit Corp. v. Uzan, 388 F.3d 39 (2d Cir.2004) (“Uzan II”), is here presumed.
