— Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to annul a determination of the Comptroller which denied petitioner’s application for additional retirement service credits. Petitioner was elected to the positjon of Commissioner of the Roslyn Water District in the Town of North Hempstead, effective January 1, 1956.
