Cheryle Ann Scheerer and her husband, John Scheerer, (the Scheerers) appeal from a final judgment entered in the United States District Court 2 for the Western District of Missouri, in favor of Hardee’s Food Systems, Inc. (Hardee’s), following a second trial in their action for damages resulting from injuries sustained by Mrs. Scheerer when she slipped and fell in the parking lot of a Har-dee’s restaurant in Lee’s Summit, Missouri.
