DECISION AND ORDER
LARIMER, Chief Judge.
Plaintiff, Richard L. Blanke, commenced this action in New York State Supreme' Court, Monroe County, on March 26, 1996, alleging causes of action under the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621 et seq., Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq., and the Civil Rights Act of 1991, Pub.L. No. 102-166, 106 Stat. 1071 (1991). Defendant, Rochester Telephone Corporation (“RTC”), removed the action to this court pursuant to 28 U.S.C. §§ 1331 and 1441(b) on April 25, 1996.
