On April 26, 1905, Bernard Heeney, father of Marie Heeney, a child eleven years of age, petitioned the circuit court of Cook county for a writ of habeas corpus to inquire into the cause of the detention of said Marie Heeney by the appellant, Ellen Sullivan. He alleged in the petition that Ellen Sullivan claimed the custody of said Marie Heeney by virtue of a decree of adoption entered in said circuit court on November 18, 1903, upon the petition of Peter Sullivan, who afterward died, and the said Ellen Sullivan. .
