This matter is before the Court on Defendant’s motion challenging the constitutionality of the death penalty and various aspects of the Federal Death Penalty Act (FDPA). (Dkt. No. 291). The Government filed a memorandum in opposition and the Defendant filed a reply. (Dkt. Nos. 320, 368).
