Defendant, age 15, was charged with and convicted of the crimes of assault with intent to rob being armed contrary to MCL 750.89; MSA 28.284, and assault with intent to commit murder contrary to MCL 750.83; MSA 28.278. At the time these offenses occurred, defendant had a history of mental treatment and was a ward of the state. The prosecutor sought to have the probate court waive juvenile jurisdiction over defendant so that he could be tried as an adult in Oakland County Circuit Court.
