ARANT, Circuit Judge.
Appellee brought suit in the District Court to recover an assessment upon stock owned by John G. Telford in the First National Bank — Detroit. Appellant’s defense is that the claim has been denied by a Commissioner on Claims against the estate of the deceased stockholder, appointed by the Probate Court of Wayne County, Michigan, and that the unappealed decision of the Commissioner is a bar to the present suit.
