DAWKINS, District Judge.

Appellant, plaintiff below, prosecutes this appeal from a jury verdict and judgment in favor of defendants, appellees, and complains mainly of charges given and requests denied by the trial judge. The action was for alleged damages both actual and exemplary and charged that appellees knowingly and fraudulently misrepresented to him conditions with respect to tests and showings for the production of oil at three separate locations, upon the faith of which he made certain investments.
