The issues presented on this appeal sufficiently appear from the recitals of the judgment from which this appeal comes. This judgment reads as follows:
“On this day these two causes, being consolidated, coming on to he heard, the State being present by Hon. George H. Holmes, prosecuting' attorney, and the defendants being present by their attorney, E. P.
