Appeal by the plaintiff, the Fanners’ -Rational Bank of Annapolis, from an order of the Supreme Court, made at the Rew York Special Term and entered in the office of the clerk of the county of Rew York on the 23d day of December, 1895, denying its motion to vacate an order for the examination of the president of the plaintiff before- issue joined.

Per Curiam :

The motion below was to vacate the order for the examination Of one of the officers of the plaintiff under subdivision•7 of section 872 of the Code. R o motion was made to vacate the orders directing the service of the order, for the examination upon the person who was to be examined without the State, nor is the question presented as to the power of the court to direct such a service. The only *374question presented on this motion was whether of not upon the papers presented the order for the examination of this officer of the plaintiff was authorized by the Code.
