BARROW, Justice.

This is a suit by appellant against ap-pellees for condemnation for an easement to inundate 805.57 acres of land and the improvements thereon, situated in Live Oak County, Texas. The case was tried to a jury and judgment rendered on the verdict for $627,500. This appeal is from that judgment.

Appellant, by its points one to eight, inclusive, complains of the action of the court in holding that the income tax returns of appellee Sellers, as well as the record supporting such returns, were privileged and inadmissible in evidence, in quashing a subpoena duces tecum requiring the…
