William W. Cooper, one of the defendants in the court below, was clerk of the district court for Dixon county for a term of four years ending in January, 1900. His codefendants were sureties on his official bond. During Cooper’s incumbency Thomas J. Sheibley, plaintiff, was a party to some litigation in that court, the costs of which were taxed against him by Cooper.
