Judgment, Supreme Court, Bronx County, rendered June 1, 1973, convicting defendant, after a jury trial of the crimes of assault in the first degree, assault in the second degree and possession of a weapon as a felony, unanimously modified, on the law, to the extent of reversing the conviction for assault in the- second degree, vacating the concurrent sentence imposed thereon, and dismissing that count of the indictment, and as so modified, the judgment is otherwise affirmed.
