THE object of this action by the plaintiffs, F. C. Franklin and Arthur Jones, against the defendants, C. C. Calvat and Hommerez Dusserre, is to recover both actual or compensatory, and exemplary, damages for their alleged unlawful entry upon, and use for pasturage of, certain lands in Garfield county of which the plaintiffs had the right of possession under a lease from one Slusser, the owner in fee except as against the United States, and which were filed upon and acquired by Slusser as placer mining claims embracing about 2,251 acres of land.
