RAMSEY, Judge.
The appeal in this case is prosecuted from a conviction had in the District Court of Comanche County on May 2 of this year, adjudging appellant guilty of assault with intent to murder, and assessing his punishment at two years confinement in the penitentiary.
The facts of the case briefly show that Will Smith, the assaulted party, was a young lad about sixteen years old at the date of the difficulty.
