Order insofar as it resentenced defendant unanimously reversed on the law and matter remitted to Steuben County Court for resentencing in accordance with the following Memorandum: In 1982 defendant was convicted of murder in the second degree (Penal Law §§ 20.00, 125.25 [1]); attempted murder in the second degree (Penal Law §§ 20.00, 110.00, 125.25 [1]); and criminal possession and criminal sale of a controlled substance in the first degree (Penal Law § 220.21 [1]; § 220.43 [1]).
