This is a suit by The People of Puerto Rico to enjoin as a common nuisance the operation by the defendants of a gambling room at the Escambrón Beach Club in San Juan. The People have appealed from an order of the district court denying a preliminary injunction.

There is no dispute that the defendants operate a dance floor, a restaurant, a bar, and some apartments on the first floor of the Escambrón; that these facilities are regularly used by the general public in an orderly manner; and that the so-called game room ..which is the object of this controversy is…
