This is an appeal from an order of the district court denying appellants’ motion for a preliminary injunction against those parts of the regulations promulgated by the United States Fish & Wildlife Service (FWS) which permit hunting in the Atlantic Flyway states of the greater snow goose 1 and the Atlantic brant during a limited season in 1975-76. 2 The facts are generally set forth in the opinion of the district court and except as they relate to our discussion of the issue on appeal need not be repeated here, although it is significant and should be noted that appellants’ counsel at oral…
